The Supreme Court has permitted candidates appearing in the All India Bar Examination (AIBE) and Common Law Admission Test (CLAT) to engage scribes who possess qualifications higher than 10+2, provided they are not law graduates.<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/vidhigya.com\/blog\/wp-content\/uploads\/2026\/02\/ChatGPT-Image-Feb-13-2026-05_37_17-PM-1024x683.png\" alt=\"Supreme Court Scribe Rule for AIBE and CLAT: Visually Impaired Candidates Can Choose Graduated Scribes\" class=\"wp-image-1496\" srcset=\"https:\/\/vidhigya.com\/blog\/wp-content\/uploads\/2026\/02\/ChatGPT-Image-Feb-13-2026-05_37_17-PM-1024x683.png 1024w, https:\/\/vidhigya.com\/blog\/wp-content\/uploads\/2026\/02\/ChatGPT-Image-Feb-13-2026-05_37_17-PM-300x200.png 300w, https:\/\/vidhigya.com\/blog\/wp-content\/uploads\/2026\/02\/ChatGPT-Image-Feb-13-2026-05_37_17-PM-768x512.png 768w, https:\/\/vidhigya.com\/blog\/wp-content\/uploads\/2026\/02\/ChatGPT-Image-Feb-13-2026-05_37_17-PM.png 1536w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>A bench comprising:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Chief Justice Surya Kant<\/li>\n\n\n\n<li>Justice Joymalya Bagchi<\/li>\n\n\n\n<li>Justice NV Anjaria<\/li>\n<\/ul>\n\n\n\n<p>accepted the suggestions made by the petitioners.<\/p>\n\n\n\n<p>The Court held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;<em>Visually impaired candidates appearing for AIBE are entitled to have assistance of a scribe who is an undergraduate and not pursuing law or humanities. There is no bar on a scribe having qualifications higher than 10+2 schooling<\/em>&#8220;<\/p>\n<\/blockquote>\n\n\n\n<p>This means:<\/p>\n\n\n\n<p>\u2714 A scribe can be a graduate<br>\u2714 A scribe can have qualification beyond 12th<br>\u2714 But the scribe must NOT be a law graduate<br>\u2714 The scribe must not be pursuing law or humanities courses<\/p>\n\n\n\n<p>This clarification is the core of the new <strong>Supreme Court scribe rule for AIBE and CLAT<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Directions Issued to Authorities<\/h2>\n\n\n\n<p>The Court directed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>Bar Council of India (BCI)<\/strong><\/li>\n\n\n\n<li>The <strong>Consortium of National Law Universities (NLUs)<\/strong><\/li>\n<\/ul>\n\n\n\n<p>to formally notify and implement these changes before the next AIBE or CLAT examination.<\/p>\n\n\n\n<p>Additionally:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Respondents must file a compliance affidavit within two weeks.<\/li>\n\n\n\n<li>The matter is listed for next hearing on <strong>March 20, 2026<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>The Court observed that the suggestions are consistent with guidelines issued by the Ministry of Social Justice and Empowerment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The <strong>Supreme Court scribe rule for AIBE and CLAT<\/strong> marks a progressive step towards inclusivity in legal education and professional testing. By removing the rigid 10+2 qualification cap, the Court has ensured that visually impaired candidates can access competent scribes without unnecessary restrictions.
