You may wonder: Can the person be held legally responsible for the harm caused to you?

This is where the law of torts comes into play.

Tort law deals with situations where one person commits a civil wrong against another and the injured person may seek a legal remedy.

What is a Tort?

The word “Tort” comes from the French word tort, meaning “wrong.”

In simple terms, a tort is a civil wrong, other than a breach of contract, for which the law provides a remedy.

A tort generally arises when a person:

commits a wrongful act or omission;

violates a legally protected right of another person; and

causes legally recognised harm or injury.

For example, if a person drives negligently and injures a pedestrian, the injured person may have a claim in negligence, a branch of tort law.

The central idea can be remembered as:

Wrongful conduct + violation of a legal right + legal remedy = Tort

However, every act that causes harm is not necessarily a tort. The law must recognise the conduct as a legal wrong.

Nature of Tort

Understanding the nature of tort helps us understand how tort law operates.

1. Tort is a Civil Wrong

A tort is primarily a civil wrong. The person who suffers the injury, known as the claimant or plaintiff, may seek a remedy against the person responsible.

The most common remedy is damages, meaning monetary compensation.

For example, if A’s negligence causes injury to B, B may seek compensation from A.

2. The Duty is Generally Imposed by Law

In tort law, the duty owed by one person to another generally arises from law, rather than from an agreement between the parties.

For example, a driver has a legal duty to take reasonable care while driving. The driver does not need to enter into a contract with every pedestrian before that duty exists.

This distinguishes tort from breach of contract, where the duty usually arises from an agreement.

Remember:
Tort → Duty generally arises from law

3. Violation of a Legal Right is Important

A person suffering loss does not automatically have a claim in tort.

The law generally requires the violation of a legal right or legally protected interest.

This is explained through two important principles:

Injuria Sine Damno

It means “legal injury without actual damage.”

A person’s legal right may be violated even though they have not suffered measurable financial loss.

Damnum Sine Injuria

It means “damage without legal injury.”

A person may suffer actual loss, but if no legal right has been violated, there may be no action in tort.

Therefore:

Every loss is not a tort, and every legal injury does not necessarily require financial damage.

4. Intention is Not Always Necessary

A person does not always have to intend to cause harm to be liable in tort.

For example, in negligence, a person may be held responsible for failing to exercise reasonable care even though they did not intend to injure anyone.

Thus, tortious liability may arise from intentional acts, negligence, or other circumstances recognised by law.

5. Compensation is a Major Remedy

One of the main purposes of tort law is to provide a remedy to the person who has suffered a legally recognised injury.

The most common remedy is damages or monetary compensation.

Depending on the circumstances, courts may also grant other remedies, such as an injunction, which is an order directing a person to do or stop doing something.

6. Tort Law is Largely Based on Judicial Principles

In India, tort law has developed significantly through judicial decisions and common-law principles rather than through one comprehensive statute called the “Tort Act.”

Courts have developed important principles relating to areas such as negligence, nuisance, defamation, strict liability, and absolute liability.

The easiest way to understand tort is to think of it as the law’s response to certain wrongful conduct that causes a legally recognised injury to another person.

While solving question focus on the basic chain:

Who did what? → Was there a legal duty? → Was a legal right violated? → Did the conduct cause legally recognised injury? → Is a legal remedy available?

Once this basic framework is clear, the concepts of tort become much easier to understand and apply.

Practice Question

Principle

A tort generally arises when a person breaches a legal duty owed to another and the law provides a remedy for the resulting legal injury.

Facts

Kabir owns a shop in a busy market. Neha opens a new shop next to his and sells similar products at lower prices. As a result, several of Kabir’s customers start purchasing from Neha, and Kabir’s profits decrease significantly.

Kabir claims that Neha has committed a tort because her business has caused him financial loss.

Question

Which of the following is the best conclusion?

A. Neha is liable because every financial loss caused by another person amounts to a tort.

B. Neha is automatically liable because she opened her shop next to Kabir’s.

C. Neha is not necessarily liable merely because Kabir suffered financial loss, unless a legally protected right has been violated.

D. Neha is liable because competition between two businesses is unlawful.

Answer: C

Why?

Kabir has suffered damage in the form of financial loss. However, financial loss by itself does not necessarily establish a tort. The crucial question is whether Neha violated a legal right of Kabir.

This tests the distinction between damage and legal duty.

Imagine that you are walking on the road when a person, driving carelessly, hits you and causes an injury.
