B wants compensation for medical expenses, while the State wants to prosecute A for the offence.

This simple example shows how one act can have both civil and criminal consequences.

But what exactly is the difference between a tort and a crime?

What is a Tort?

A tort is a civil wrong for which the injured person can seek a legal remedy, usually compensation or damages.

Example

A carelessly drives his car and damages B’s vehicle. B can approach the court and claim compensation for the loss.

The focus is:

“How can the person who suffered harm be compensated?”

What is a Crime?

A crime is an act or omission that is considered an offence against society and is punishable by the State.

Example

A steals B’s phone. Theft is not treated merely as a private dispute between A and B. It is an offence against society, and the State can prosecute A.

The focus is:

“How should the offender be punished?”

Tort vs Crime: Key Differences

Basis

Tort

Crime

Nature

Civil wrong

Criminal/public wrong

Mainly affects

Individual

Society

Main purpose

Compensation

Punishment

Proceedings generally initiated by

Injured person

State

Standard of proof

Preponderance of probabilities

Beyond reasonable doubt

Common consequence

Damages/other civil remedies

Imprisonment, fine, or other prescribed punishment

Can One Act Be Both a Tort and a Crime?

Yes.

Suppose A intentionally attacks B and causes serious injury.

There can be two separate legal consequences:

Criminal: The State may prosecute A.

Civil: B may seek compensation for the injuries suffered.

Therefore:

One act can give rise to both civil and criminal liability.

What About Mens Rea?

Mens rea refers to the mental element involved in criminal responsibility, such as intention or knowledge, where required by the particular offence.

For example, accidentally breaking someone’s window and deliberately breaking it may have very different legal consequences.

However, do not assume that every crime requires the same mental element. The requirement depends on the particular offence.

How to Identify Tort vs Crime

When given a legal situation, ask these five questions:

1. Who has suffered the harm?

Is it primarily an individual or society?

2. Who is bringing the case?

Is it the injured person or the State?

3. What is being sought?

Compensation under tort law
Punishment under criminal law.

4. What is the standard of proof

Preponderance of probability in civil case.
Beyond reasonable doubt in criminal case.

5. Can both apply?

Always remember that the same conduct can sometimes create both civil and criminal liability.

TORT

Civil wrong → Compensation → Individual

CRIME

Public wrong → Punishment → Society

Golden Rule

Tort focuses mainly on the victim’s remedy; crime focuses mainly on the offender’s punishment.

PRACTICE QUESTION

Principle

A tort generally gives rise to a civil remedy, while a crime is an offence for which the State may prosecute and punish the offender. The same conduct may, in appropriate circumstances, result in both civil and criminal liability.

Facts

Arjun carelessly drives his car and hits Rohan. Rohan suffers injuries and claims ₹1 lakh as compensation. The State also initiates criminal proceedings against Arjun under the applicable law.

Question

Which statement is most appropriate?

A. Only criminal liability can arise because Rohan was physically injured.

B. Only tortious liability can arise because Rohan is seeking compensation.

C. The same conduct may give rise to both civil and criminal liability.

D. No liability can arise because Arjun did not intentionally injure Rohan.

Answer:C

Why?
Rohan’s claim for compensation represents the civil dimension, while the State’s prosecution represents the criminal dimension. The same conduct can therefore attract both, depending on the applicable law.

Tort vs Crime: Understanding the Difference Imagine that A is driving carelessly and hits B, causing serious injuries.
